§ 1 General Provisions & Application
1.1 These Terms and Conditions apply to all services provided by Parently through the website Parently.se.
1.2 Scope of Application: These General Terms and Conditions (hereinafter referred to as "GTC") in the version valid at the time of the order by the customer apply to all orders placed through the online shop www.parently.se.
1.3 By using our website, placing an order, or renting products from Parently, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with any other policies referenced herein.
1.4 Parently reserves the right to update or amend these Terms and Conditions at any time. We will notify users of any changes by updating the terms on our website. Continued use of the website following such changes will be deemed acceptance of the new terms.
§ 2 Service Definition
2.1 Conclusion of the Contract
-
The mere presentation of rental and purchase items in the online shop does not constitute a legally binding offer for the conclusion of a rental and/or purchase contract. The product range in the online shop is non-binding and subject to change. By clicking the "Order Now" button, the customer submits a binding offer to conclude a rental and/or purchase contract, provided they have previously agreed to these terms and conditions by checking the designated box and have acknowledged the cancellation policy.
-
The receipt of the customer’s order is confirmed immediately by email; however, this order confirmation does not yet constitute acceptance of the offer by Parently. It serves merely to inform the customer of the receipt of the order and contains the legally required information about Parently as a potential rental and/or purchase contract partner, along with these terms and conditions and the cancellation policy.
-
The acceptance of the contract by Parently occurs through a separate order confirmation via email. If a rental and/or purchase item is not available or not available in the corresponding version, the customer will receive a notification email within 3 business days.
-
Parently reserves the right, in the case of an offer to conclude a rental agreement initiated by the customer by triggering the order process, to request a rental deposit of up to 50% of the new purchase price prior to contract acceptance.
2.2 Payment: Payment for the rental shall be made according to the provisions in the Confirmation or as otherwise directed by Parently. If payment is delayed, interest on arrears of 8 percent will be charged from the date the monthly payment was due. Parently reserves the right to charge for issued payment reminders and delay fees according to Parently's current policy at any given time.
2.3 Prices: All prices for rental are stated in SEK, including VAT, unless otherwise specifically indicated. Delivery and return fees apply according to the information provided on the website. Parently reserves the right to annually adjust the price for ongoing rentals in accordance with the consumer price index (CPI).
2.4 Rental Period: The rental period begins on the date the customer receives the product, in accordance with the agreed delivery or pickup arrangement. It is the customer's responsibility to collect the product on time if pickup has been agreed. If Parently causes a delivery delay, the rental period will begin upon actual delivery. The rental runs for the agreed duration, and the customer has the option to extend the rental agreement in writing.
2.5 Right of Withdrawal: We differentiate between short-term rental products (less than 3 months) and long-term rental products (3 months or longer):
a) Right of Withdrawal for Short-Term Rental Products
i) If you cancel at least 6 days before the scheduled delivery date, you are entitled to a 100% refund.
ii) If you cancel within 5 days of the scheduled delivery date or return the product earlier than agreed, no refund will be issued. This is because short-term rental products are reserved exclusively for you for the ordered period and are limited in availability.
b) Right of Withdrawal for Long-Term Rental Products (3 months or longer)
i) If you cancel before the product has been picked up by our logistics partner (normally at least 6 days before the delivery date), you are entitled to a 100% refund.
ii) If you cancel after the product has been picked up but before you accept or collect it, you will receive a refund minus a fee of 199 SEK. This fee covers the logistics partner's cost for preparing and returning the product.
iii) Once you have received or picked up the product, the rental service is considered to have started. You then have the right of withdrawal within 14 days from receipt. However, if you exercise this right, we will charge the rental fee for the first 3 months to cover costs already incurred (such as logistics, cleaning, and inspection).
2.6 Contract Termination
a) Short-Term Rentals
Short-term rentals have a predefined rental period and end automatically after the agreed duration, provided the product is returned on time. If the product is not returned, additional rental fees may apply.
b) Long-Term Rentals
For long-term rentals, the rental period indicated at the time of order serves as the initial contract duration. However, you may choose to terminate early.
If you terminate early, a one-time adjustment fee will apply. This fee is calculated as the difference between the amount you have already paid and the amount that would have been due for the shorter rental period actually used.
Example: Suppose you initially plan to rent a stroller for 12 months at a monthly fee of 500 SEK. If you decide to cancel after 6 months, the total you have paid so far is 3,000 SEK (6 months x 500 SEK). However, the rental cost for a 6-month rental is 550 SEK per month, totalling 3,300 SEK (6 months x 550 SEK). Therefore, you would owe an additional fee of 300 SEK (3,300 SEK - 3,000 SEK). To find out the exact cancellation fee for your rental, please contact us.
Upon receipt of the payment and item, your Rental Plan will be terminated, and no further Monthly Fees will be charged. If the item is not returned promptly, the Rental Plan will continue, and missed payments will be collected, with Monthly Fees resuming until the item is received.
2.7 Non-Payment: If payment fails, Parently will attempt to process it two additional times. Each attempt will be accompanied by a reminder email with the option to manually transfer the outstanding fee to Parently's bank account. If payment remains unsettled after these reminders, Parently reserves the right to charge collection costs of 180 SEK per collection (according to Section 5 of the Debt Recovery Act), a payment reminder fee of 60 SEK per overdue invoice, and will request the immediate return of the item.
Parently reserves the right to transfer unpaid invoices to third-party debt collection agencies.
Failure to return the unpaid item within 7 days may result in legal action. Furthermore, Parently reserves the right to charge: a) for a rented new product, the full retail price as listed by the brand, or b) for a rented "pre-loved" product, the retail price listed by the brand minus a 15% "pre-loved" discount.
2.8 Terms of Use and Insurance: The Customer shall observe and comply with the following terms during the rental period:
- (a) The Customer has a general duty of care regarding the Rental Item and should prevent deterioration beyond normal wear and tear, taking reasonable care.
- (b) The Customer may use the Rental Item only in accordance with the Agreement, accompanying instructions, and for its intended purposes.
- (c) The Rental Item is provided as-is and may show signs of previous use by other customers, resulting in normal wear.
- (d) Traveling with the Rental Item is allowed, but the Customer must store it safely to prevent damage. If the item cannot be securely stored, it should be carried as hand luggage.
- (e) The Customer must handle and store the Rental Item to avoid damage, unauthorized use, or theft. Parently will cover replacement and/or delivery of spare parts if damages occur through normal usage.
- (f) The Customer may not sublease or re-rent the Rental Item without permission from Parently.
- (g) The Customer may not alter or remove any identifying markings on the Rental Item. Any destruction or illegibility of these markings must be reported to Parently immediately.
- (h) The Customer may not incorporate the Rental Item into real or movable property.
- (i) The Customer is prohibited from pledging, transferring, or otherwise granting rights to the Rental Item to third parties.
- (j) In the event of careless use or loss of the rental property (or parts), the customer must compensate for the damage caused.
2.9 Inspection and Return of Rental Items: Upon return, the Rental Item must be in good condition, considering normal wear and tear, and should include all parts provided. Washing is not required. The Customer must announce returns via the self-service portal, after which they will receive detailed return instructions, including access to the return portal. The item is considered returned once received at Parently’s warehouse and marked as returned. If a Customer announces a return, they must care for the item until it is returned. If the item is not returned on time, rental fees will continue to accrue.
2.10 Theft and Loss: In the event of theft, the Customer is responsible for submitting a police report to Parently. Until the report is received, rental fees will continue to be charged. Parently may provide a replacement item for a one-time fee upon submission of the police report. This fee is based on the manufacturer's official sales price list. If the item is seized, confiscated, or comes into third-party possession, Parently must be notified immediately.
2.11 Credit Checks: During the order process, Parently is executing credit checks via a third party provider (CRIF, Creditsafe, Upplysning Checknode AB). A positive credit check is required for the rental agreement to become valid. The number of credit reports does not affect creditworthiness, rating, scoring or future credit assessments. We neither save nor publish credit information taken.
If a Customer attempts to bypass a negative credit check by making multiple purchase attempts, Parently reserves the right to charge a fee of 30 SEK per credit check to cover associated costs, along with a one-time administration fee of 300 SEK.
2.12 Availability: All rental agreements are subject to availability. Parently does not guarantee the availability of specific products at any given time.
§ 3 Services and Support from Parently when Concluding a Rental Agreement
3.1 In the event of the conclusion of a rental agreement, the rental item—potentially configured according to the customer's preferences—will be shipped to the customer and provided for the contractually agreed duration of the rental period. Parently will make every effort to deliver the item on the delivery date requested by the customer.
3.2 The rental item is provided to the customer on a rental basis only. Parently remains the owner of the rental item, and ownership is not transferred to the customer.
3.3 The scope of delivery for the rental item is determined by the product description of the item provided in the online shop.
3.4 Parently is responsible for the maintenance and repair of the rental item to the extent that the wear and tear of the rental item is due to its intended use by the customer (hereafter referred to as a "service case"). Service due to willful or grossly negligent damage to the rental item, is excluded.
3.5 Parently will strive to maintain, repair, or service the rental item within 48 hours after the customer has contacted Parently by phone, email, or chat. The customer should provide appropriate evidence of the required maintenance or repair in their service request.
3.6 If the customer requests service not due to a service case, Parently has the right to charge a fee as agreed with the customer.
3.7 If Parently replaces a rental item, the item to be exchanged must be immediately handed over or returned by the customer to Parently.
§ 4 Rental Period/Term of Rental/Due Date of Rent (applies only to rental agreements with the customer)
4.1 The rental period begins on the delivery date chosen by the customer for the rental item, or at the latest upon delivery of the rental item if delivery occurs after the desired delivery date. The customer can select the desired duration of the rental period when placing the order.
4.2 The rental period is automatically extended by an additional month if the rental agreement is not terminated at least 2 weeks before the rental period ends, and if the rental item does not arrive at Parently's warehouse by the day before the end of the rental period. The customer is responsible for ensuring timely return. Parently or Parently’s contractual partners cannot ensure timely returns.
4.3 The rent is due monthly in advance for the upcoming month.
§ 5 Extraordinary Termination (applies only to rental agreements with the customer)
5.1 Both contractual parties are entitled to terminate the rental agreement without notice if an important reason exists, insofar as the other party has breached its contractual obligations to such a significant extent that it is unreasonable for the other party to continue the rental agreement.
5.2 An important reason for Parently to terminate includes (but is not limited to) the following:
- The customer is in arrears with the payment of two consecutive monthly rents or an amount equivalent to at least two monthly rents.
- Enforcement measures are taken against the customer and/or there are registered entries in the debtor's register.
- The customer uses the rental item in a significantly non-contractual manner despite warnings from Parently.
- The customer repeatedly makes unjustified use of the offered service under §3 despite warnings from Parently, particularly in cases where no significant wear of the rental item exists or where wear occurs due to improper use/deliberate damage and/or destruction.
§ 6 Special Conditions for the Conclusion of Purchase Contracts with Parently
6.1 Parently marks items for sale in the online shop as "purchase products," for which the customer can submit an offer to conclude a purchase contract at the specified purchase price.
6.2 The statutory provisions apply with regard to liability for material defects (warranty).
6.3 Until full payment of the purchased item has been made, ownership remains with Parently (retention of title).
6.4 Parently is entitled to make partial deliveries (items being out of stock or shipped from different locations), provided this is reasonable for the customer and if the customer's interest in the entire contract has not been nullified by the partial delay or partial delivery.
§ 7 User Accounts and Registration
7.1 Customers must create a user account to place orders and access our services. You are responsible for maintaining the confidentiality of your account information.
7.2 You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
7.3 Parently reserves the right to suspend or terminate accounts if false, inaccurate, or incomplete information is provided, or if any unlawful or fraudulent activity is detected.
§ 8 Payment and Security
8.1 All rental fees and charges are due at the time of order placement. Parently accepts payments through various payment methods as displayed on the website.
8.2 The website may require you to provide your personal ID and date of birth for credit checks, as required by our provider, Credit Safe. If you do not have a personal ID, you may enter 'noID' for a manual credit check.
8.3 By providing payment details, you confirm that you are authorized to use the chosen payment method and that all payment information is accurate.
8.4 Parently reserves the right to delay or refuse any orders due to security concerns or payment issues.
§ 9 Delivery and Returns
9.1 Parently delivers rental items to addresses within Sweden. Delivery times and charges may vary based on the location and specific product ordered.
9.2 If the customer selects delivery to a service point, Parently reserves the right to charge a fee of SEK 199 for deliveries that are not collected within the specified time frame.
9.3 Customers must inspect items upon delivery and notify Parently within 24 hours of any defects or issues.
9.4 At the end of the rental period, customers must return the items in their original packaging, with all components as listed in the manufacturer's parts list.
9.5 Parently provides a self-print return label for the items. It is the customer’s responsibility to follow the return instructions provided and ensure items are returned on time.
§ 10 Liability and Warranty
10.1 In the case of slight negligence, Parently is only liable for the violation of essential contractual obligations (cardinal obligations), meaning those obligations that the contract is intended to impose on Parently according to its content and purpose or whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the Customer regularly relies and is entitled to rely. This liability is limited to typical damages that were foreseeable at the time of the contract conclusion.
10.2 The personal liability of the legal representatives, agents, and employees of Parently for damages caused by them through slight negligence is also limited to the extent described in Section 8.1
10.3 Parently is not liable in cases of unauthorized and/or illegal use of the rental and purchase items.
10.4 The aforementioned liability limitations do not apply in cases of intentional or grossly negligent damages, for damages caused by fault resulting in bodily harm (injury to life, body, and health), as well as for liability under the Product Liability Act and in cases of other mandatory liability provisions. Furthermore, they do not apply if and to the extent that Parently has assumed a guarantee.
10.5 The Customer is fully liable according to the statutory provisions.
§ 11 Privacy and Data Protection
11.1 Parently values customer privacy and is committed to protecting personal data. Please refer to our Privacy Policy for detailed information on data collection, use, and storage.
11.2 By using our services, you consent to the collection and processing of your personal data in accordance with applicable laws and the terms outlined in our Privacy Policy.
